What Should I Do If I Lose My Trademark Registration Certificate?

A lost paper registration certificate can be reissued upon application. Certificates are now issued electronically and can be re-downloaded online at any time, so loss is no longer a real concern.

With the current electronic registration certificate, there is no real risk of loss—you can log in to the online trademark service system and re-download it at any time. A paper registration certificate obtained before 2022 that is lost or damaged can be reissued by filing an application for reissue of the trademark registration certificate with the CNIPA.

Electronic Certificates: Just Re-Download

The electronic registration certificate is issued as a data message and stored in the system. If you accidentally delete the file or change devices, simply log in to the online service system with the original account and download it again; its effect is unaffected. If you filed through a trademark agency, contact the agency to provide it again.

Reissue Process for Paper Certificates

Under Article 64 of the Implementing Regulations of the Trademark Law, where a trademark registration certificate is lost or damaged, an application for reissue of the trademark registration certificate must be submitted to the CNIPA. The application can be filed through the online service system or through a trademark agency, stating the registration number and the reason for reissue. Once approved, an electronic certificate is reissued.

Points to Note

  • Reissue does not change the registration number or the content of the right; the old and new certificates refer to the same right;
  • If the certificate contains incorrect information, the remedy is correction, not reissue—the two procedures are different;
  • Enterprises are advised to establish a trademark certificate archiving system with multiple backup copies of electronic certificates to reduce the cost of replacement.
