Trademark Assignment

Trademark assignment (legally transferring the exclusive right of a registered mark to another party) must be filed jointly by buyer and seller with CNIPA and takes effect only after approval and publication. A private contract without recordal transfers nothing. We handle filing and recordal end to end.

FAQ

Does signing the contract complete the transfer?

No. Assignment takes effect only after CNIPA approval and publication — until then the assignee has no exclusive right. Official recordal is a must.

What should I check before buying a mark?

Whether it is pledged, licensed to others, or judicially frozen — all can block the transfer. Our check covers these 3 statuses.

Must similar marks under the same owner transfer together?

In principle yes. Trademark law requires identical/similar marks on the same or similar goods under one registrant to be assigned together; otherwise CNIPA will require them to be assigned together, and failure to comply means the assignment will not be approved.

What if the assignment fails?

If a status issue (e.g. freeze) blocks the transfer, it surfaces at the check stage; before filing, fees can be negotiated back. After filing, the official fee is non-refundable.
