FAQ

Is an unrecorded license contract valid?

The contract itself is valid, but without recordal it cannot stand against bona fide third parties. If the mark is later assigned, the assignee may claim no knowledge of the license — the licensee's rights are hard to protect.

Do both parties file the recordal?

The licensor (trademark owner) files it with CNIPA, based on the license contract signed by both parties.

What license types are there?

Exclusive (only the licensee may use), sole (only you and the licensee), and non-exclusive (you may license others too) — very different scopes. Read the clauses before signing; our review checklist flags the key differences.

What does the fee include?

The recordal official fee plus service fee, per filing. For licenses covering multiple marks, we confirm the total before ordering.
